Operating as a secondhand dealer or a pawnbroker

If you want to deal in second-hand goods and/or operate as a pawnbroker, you must apply for a licence.

Law reform effective as from 1 January 2025

The new Danish Act on Dealing in Second-Hand Goods and Pawnbroking Activities came into force on 1 January 2025. Subsequently, a permanent establishment is no longer a requirement, nor need authorised ledgers be kept anymore. However, the applicant must inform the police about the location of the business' accounting records.

Now, private individuals' dealings in or purchasing of second-hand goods will also be comprised by the Act if the relevant person purchases second-hand goods for business purposes with a view to reselling them, unless such activity only takes place occasionally.
As a main rule, it will be considered to be dealing for business purposes if a private individual purchases goods at flea markets, etc., in antique and second-hand shops, at online auctions or other online sales platforms with a view to reselling them, and in such cases the relevant person must comply with the regulatory requirement of obtaining a licence.

You can apply as an individual or as a business. If you apply as a business, all board members and executive directors must sign the form.

Managers no longer need approval.

GOOD TO KNOW
The expected processing time is eight weeks from the day when we have received all relevant information.
  • Dealing in or purchasing of second-hand goods that is not part of the usual activities of a commercial enterprise dealing in new goods or a craftsman or an industrial enterprise
  • Selling second-hand goods at online auctions
  • Loans against security, including security in lottery tickets, and arranging such loans (pawnbroking)
  • Purchasing goods with a right of repurchase for the seller

The price of lodging an application with the police is DKK 300.
